1. These Terms of Use

1.1These terms of use ("Terms"), alongside our Privacy Notice, set out the basis on which you may access and use our website at omea.io (our "Site").

1.2By accessing or using our Site, you confirm that you accept these Terms and agree to abide by them. If you do not agree to these Terms, you must not use our Site.

1.3Our Site provides information about Omea and allows you to join a waitlist. It does not provide the Omea programme itself.

1.4The Omea programme is provided separately and is governed by its own terms ("Programme Terms"), which we will provide to you before you join. Where these Terms and the Programme Terms differ, the Programme Terms apply to your participation in the programme.

1.5We reserve the right to change or modify portions of these Terms at any time. If we do, we will update this page and change the date shown at the top. Your continued use of the Site after a change means you accept the updated Terms.

2. Information about us

2.1Our Site is owned and operated by Omea Group Ltd ("Omea", "we", "us" or "our"). We are a company incorporated in England and Wales under company number 17035493. Our registered office address is 46 New Cavendish Street, London, W1G 8TP.

2.2You can contact us at connect@omea.io, or by post at the address above. Where we need to contact you, we will do so by email using the address you have given us.

2.3By using our Site you understand and accept that we do not provide medical services, and that our Site is not to be used in an emergency situation or instead of your general practitioner (GP). IF YOU BELIEVE THAT YOU OR THE PERSON YOU ARE ASSISTING IS IN AN URGENT OR EMERGENCY SITUATION YOU SHOULD IMMEDIATELY DIAL 999 OR SEEK ALTERNATIVE EMERGENCY MEDICAL SERVICES. YOU SHOULD CALL 999 in a critical or life-threatening situation, such as (but not limited to) if someone has: difficulty breathing, severe bleeding that cannot be stopped, severe chest pain, loss of consciousness, acute confused states or fits which are not stopping, or a suspected heart attack or stroke. If you have medical conditions or concerns, you should consult your GP or call NHS 111.

3. Who may use our site

3.1Our Site is intended for adults. To join our waitlist you must be 18 or over and have the legal right, capacity and ability to accept these Terms on your own behalf. We do not knowingly collect information from anyone under 18. If you believe that a person under 18 has given us their details, please contact us and we will delete them.

3.2Our Site is directed at users in the United Kingdom, and the Omea programme will be available in the United Kingdom only. We make no representation that our Site or the Omea programme is appropriate or available in any other country. If you access our Site from outside the United Kingdom you do so on your own initiative and are responsible for compliance with your local laws.

4. How we may use your personal information

4.1If you join our waitlist, we collect your email address and the date on which you signed up. We use this only to let you know when Omea becomes available.

4.2Our Privacy Notice sets out the terms on which we process any personal data we collect from you or that you provide to us, and explains your rights.

4.3We use only cookies that are strictly necessary for our Site to function. We do not use analytics or advertising cookies, and we do not track you across other websites.

5. Our site and the waitlist

We do not provide medical services or advice

5.1Omea is a preventive health and wellbeing service. We do not provide medical advice, diagnosis, treatment, prescriptions or professional medical opinions through our Site. We do not hold a registration with the Care Quality Commission.

5.2All information, materials and content offered on our Site is general in nature and is intended solely for informational purposes. It is not tailored to you and does not take account of your individual circumstances.

5.3Our Site should never replace professional medical care or advice. We encourage you to consult a qualified healthcare provider for any question or decision about diagnosis, treatment or ongoing care. You agree not to postpone or disregard professional medical advice because of anything you read on our Site.

5.4Accessing or using our Site does not create a doctor-patient relationship between you and Omea, or between you and any doctor, clinician or other professional working with us.

5.5To the fullest extent permitted by law, you agree that your use of our Site, and any reliance you place on the information it contains, is at your own risk.

The waitlist

5.6You may provide your email address to join our waitlist. There is no charge for doing so and no commitment on either side.

5.7Joining the waitlist does not guarantee you a place in the Omea programme. Places may be limited and eligibility conditions apply.

5.8We may change, pause or close the waitlist at any time, and we may decline any application without giving a reason.

5.9Anything we say on our Site about future features, availability, timing or pricing reflects our current plans only. It is not a promise and it may change.

5.10Nothing on our Site is an offer to supply the Omea programme, and joining the waitlist does not create a contract between us.

5.11You may unsubscribe at any time using the link in any email we send you, or by emailing connect@omea.io.

5.12You must not submit another person’s details to the waitlist without their permission, and you must not use automated means to submit entries.

6. Acceptable use

6.1You may use our Site for lawful purposes and in accordance with these Terms.

6.2You must not:

7. Intellectual property

7.1We are the owner or licensee of all intellectual property rights in our Site and in the material published on it, including the text, images, design, branding and the methodology we describe. Those works are protected by copyright and other laws and treaties around the world. All such rights are reserved.

7.2You may view our Site and print pages from it for your own personal use. You must not reproduce, republish, distribute, adapt, sublicense, sell or commercially exploit any part of our Site without our prior written permission.

7.3"Omea" and our logo are trade marks belonging to us. You may not use them without our permission.

7.4You acquire no rights or licences in or to any trade mark, service mark, trade name or copyright displayed on our Site.

7.5You may link to our home page provided you do so in a way that is fair and lawful and does not damage our reputation or take advantage of it. You must not suggest any form of association, approval or endorsement on our part where none exists, and you must not frame our Site on any other site. We may withdraw linking permission at any time.

8. Availability and accuracy of our site

8.1We do not guarantee that our Site, or any content on it, will always be available, uninterrupted, or free from errors, viruses or other harmful components. We may suspend, withdraw or restrict the availability of all or any part of our Site for business or operational reasons.

8.2The content on our Site is provided for general information only. Although we make reasonable efforts to keep it up to date, we make no representations or warranties that it is accurate, complete or current, and we are under no obligation to update it.

8.3Our Site may contain links to other sites and resources provided by third parties. Those links are provided for information only. We have no control over the contents of those sites or resources, we do not endorse them, and we accept no responsibility for them or for any loss or damage that may arise from your use of them.

8.4You are responsible for configuring your own information technology and platform in order to access our Site, and for using your own virus protection software.

9. Our responsibility for loss or damage suffered by you

9.1Nothing in these Terms limits or excludes our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or that of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; and for any of your legal rights which cannot lawfully be excluded or limited.

9.2Subject to clause 9.1, we exclude all implied conditions, warranties, representations and other terms that may apply to our Site or any content on it.

9.3Subject to clause 9.1, we will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty or otherwise, arising under or in connection with your use of, or inability to use, our Site, or your use of or reliance on any content displayed on it. This includes any indirect, incidental or consequential loss or damage, and any loss that was not reasonably foreseeable.

9.4We provide our Site for domestic and private use only. Subject to clause 9.1, if you use our Site for any commercial, business or resale purpose we will have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

10. Other important terms

10.1We may transfer our rights and obligations under these Terms to another organisation, for example if our business is sold.

10.2These Terms are between you and us. No other person shall have any right to enforce any of their terms.

10.3Each of the paragraphs of these Terms operates separately. If any of them is deemed unlawful by any court or competent authority, the remaining paragraphs will remain in full force and effect.

10.4If we delay in taking steps against you when you break these Terms, that will not prevent us from taking steps against you at a later date.

10.5These Terms, their subject matter and their formation are governed by the law of England and Wales. You and we both agree that the courts of England and Wales will have exclusive jurisdiction, except that if you are a resident of Scotland or Northern Ireland you may also bring proceedings in your own courts.
